1. Acceptance of Terms

By creating an account, accessing, or using zza.ai, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and zza.ai.

If you are using our Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use our Service. If you are under 18, you must have permission from a parent or legal guardian. By using our Service, you represent and warrant that:

3. Account Registration and Security

4. Service Description

zza.ai provides an AI-powered platform for generating videos and images. Our Service includes:

  • AI Video Generation: Text-to-Video and Image-to-Video generation with multiple AI models
  • AI Image Generation: Text-to-Image and Image-to-Image transformation
  • Effect Templates: Pre-configured cinematic effects powered by various AI providers
  • Workspace Management: Tools for organizing and managing your generated content
  • Content Gallery: Public gallery for browsing and saving featured content
  • Credit System: Pay-as-you-go credit-based pricing for AI generations

We reserve the right to modify, suspend, or discontinue any part of our Service at any time without prior notice.

5. Credits and Payments

5.1 Credit System

Our Service operates on a credit-based system:

  • Credits are required to generate AI content
  • Different generation types consume different amounts of credits based on model, duration, resolution, and other parameters
  • Credits are deducted when a generation task is successfully completed
  • Credits do not expire and remain in your account until used
  • Credits are non-transferable between accounts

5.2 Purchasing Credits

You can purchase credits through:

  • Subscription Plans: Monthly or annual subscriptions that include a set amount of credits
  • One-Time Purchases: Individual credit packages as needed

All payments are processed securely through Stripe. Prices are displayed in USD and include all applicable taxes.

5.3 Subscriptions

If you purchase a subscription:

  • Your subscription will automatically renew at the end of each billing period
  • You will be charged the then-current subscription price
  • You can cancel your subscription at any time through your account settings or the Stripe customer portal
  • Cancellation takes effect at the end of the current billing period
  • Credits included in your subscription are added to your account each billing period

5.4 Refunds

We offer refunds under the following conditions:

  • Credit purchases are eligible for refund within 7 days of purchase if credits have not been used
  • Subscription refunds are handled on a case-by-case basis
  • Refunds for technical issues or service failures will be evaluated individually

5.5 Failed Generations

If a generation task fails due to a system error or AI provider issue, the credits will be automatically released back to your account. You will not be charged for failed generations.

6. User Content and Intellectual Property

6.1 Your Content

You retain ownership of:

  • Your prompts and input materials
  • AI-generated content created through our Service
  • Images and videos you upload to our platform

6.2 License to zza.ai

By using our Service, you grant zza.ai a worldwide, non-exclusive, royalty-free license to:

  • Store, process, and transmit your content to provide the Service
  • Use your content to improve our AI models and Service (in anonymized form)
  • Display publicly shared content in our gallery
  • Use featured content for promotional purposes (with proper attribution)

6.3 Content Restrictions

You agree not to create, upload, or share content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights of others
  • Contains illegal, harmful, or offensive material
  • Depicts violence, hate speech, or discriminatory content
  • Contains explicit sexual content or nudity
  • Impersonates others or spreads misinformation
  • Violates privacy rights or contains personal information without consent

6.4 AI-Generated Content Disclaimer

AI-generated content may sometimes produce unexpected or unintended results. We do not guarantee the accuracy, quality, or suitability of generated content. You are responsible for reviewing and using AI-generated content appropriately.

6.5 Third-Party AI Providers

Our Service uses third-party AI providers (Replicate, fal.ai, etc.). Your content may be processed by these providers in accordance with their terms and policies. By using our Service, you acknowledge and agree to this processing.

7. Prohibited Uses

You agree not to use our Service to:

  • Violate any local, state, national, or international law
  • Engage in fraudulent, deceptive, or misleading practices
  • Harass, abuse, or harm others
  • Create or distribute malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems or user accounts
  • Scrape, crawl, or use automated tools to access our Service without permission
  • Reverse engineer, decompile, or disassemble our technology
  • Remove or modify any proprietary notices or labels
  • Use our Service to build a competing product or service
  • Resell or redistribute our Service without authorization
  • Generate content that could be used for illegal purposes
  • Abuse our credit system or attempt to manipulate pricing

8. Disclaimers and Warranties

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding accuracy, reliability, or quality of AI-generated content
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding third-party AI providers or their models

We do not warrant that:

  • The Service will meet your specific requirements
  • AI-generated content will be suitable for your intended purpose
  • Any errors or defects will be corrected
  • The Service will be available at all times

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZZA.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes but is not limited to:

  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or unavailability
  • Unauthorized access to or alteration of your content
  • Errors or inaccuracies in AI-generated content
  • Third-party conduct or content
  • Any other matter relating to the Service

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability will be limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless zza.ai, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Your content or any content generated through your account
  • Your infringement of any intellectual property or other rights of third parties
  • Any disputes between you and other users

11. Dispute Resolution

11.1 Informal Resolution

Before filing a formal dispute, please contact us at hi@zza.ai to attempt to resolve the issue informally. We will work with you in good faith to reach a resolution.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which zza.ai is registered, without regard to its conflict of law provisions.

11.3 Jurisdiction

You agree to submit to the personal and exclusive jurisdiction of the courts located within the jurisdiction in which zza.ai is registered for the resolution of any disputes.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Updating the "Last updated" date
  • Sending an email notification (for significant changes)

Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

13. Termination

13.1 By You

You may terminate your account at any time by contacting hi@zza.ai or through your account settings. Upon termination:

  • Your access to the Service will be immediately revoked
  • Your data will be deleted within 30 days
  • Unused credits will be forfeited (no refund for unused credits)
  • Active subscriptions will be cancelled

13.2 By Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your use poses a security risk
  • We are required to do so by law
  • We discontinue the Service

13.3 Effect of Termination

Upon termination, all rights and licenses granted to you will immediately cease. Sections of these Terms that by their nature should survive termination will remain in effect.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and zza.ai regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

14.5 Third-Party Services

Our Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party services.
